Based on the categorical connection between the field and the state of exception, I propose to discuss on this article Giorgio Agamben’s conception of the state of exception in its paradoxical relationship with the law, a relationship which is proper to the paradoxical structure of sovereignty. The field is to the Italian thinker the experience which is able to clarify the paradoxical dimension of the state of exception because it expresses itself at the same time as inside and outside the (...) legal system. On the contemporary experience the state of exception is no longer characterized as an exceptional experience, but it has become the norm. Based on this, we want to present the dialog between Agamben and Carl Schmitt, in order to reflect on the condition of the state of exception to present itself as anomy, whilst continuing to establish with the law a necessary relationship, even in the form of suspension. Advocates of the Person-Centered Healthcare (PCH) approach say that PCH is a response to a failure of caring for patients as persons. Nevertheless, there are many human subjects falling to fulfill the requirements of a traditional philosophical definition of personhood. Hence, if we take, PCH seriously, a greater clarification of the key terminology of PCH is urgently needed. It seems necessary, for instance, that the concept of the person should be extended in order to include those individuals with insipient or (...) immature levels of consciousness, as well as those who are severely and permanently mentally handicapped. In this article, we will depart from some well-known philosophical concepts of what it means to be a person and try to offer a broader and more inclusive meaning. We suggest that persons are human beings with a socially recognized biography, which implies to recognize as persons individuals with necessities, but also with narratives about their interests and claims, expressed sometimes by other people related to them. This is particularly the case of individuals that suffer from severe disorders of consciousness. For those, is not only care that matters; respect matters too. Caregivers should therefore not only sympathetically care for the well-being of these people; they should also be concerned to respect their interests and claims by interpreting them empathetically, in the light of their biographical story. Our conclusion is that, in order to be coherent, PCH must consider individuals with severe disorders of consciousness as persons and we think that our revised concept of personhood fits with this requirement. Ao longo desse artigo pretende-se demonstrar de que maneira a questão da hospitalidade se apresenta nas obras políticas de Jean Jacques Rousseau e, principalmente, qual é sua relação com a linguagem. Para tanto, começa-se demonstrando como a linguagem é a essência da hospitalidade e como ela opera tanto como obstáculo ao acolhimento do outro e como obstáculo a possibilidade da hospitalidade; tanto como tentativa de aproximação e reconhecimento e, portanto, como possibilidade à hospitalidade. Dessa maneira, será apresentado também o pensamento (...) de Derrida como intérprete e crítico de Rousseau, principalmente quando este analisa como se deu a formação da linguagem, a consequente formação da sociedade civil e as saídas possibilitadas pelo Contrato Social para que um acolhimento – mesmo que condicional – fosse possível. Conclui-se então, que na visão rousseauniana, a hospitalidade está sempre entre a entre a lei e o sentimento, a fala e a justiça sendo, entretanto, impossível um retorno a uma origem mais pura. Self-regulated learning is critical for learning across tasks, domains, and contexts. Despite its importance, research shows that not all learners are equally skilled at accurately and dynamically monitoring and regulating their self-regulatory processes. Therefore, learning technologies, such as intelligent tutoring systems, have been designed to measure and foster SRL. This paper presents an overview of over 10 years of research on SRL with MetaTutor, a hypermedia-based ITS designed to scaffold college students’ SRL while they learn about the human circulatory system. MetaTutor’s architecture and instructional features are designed based on models of SRL, empirical evidence on human and computerized tutoring principles of multimedia learning, Artificial Intelligence in educational systems for metacognition and SRL, and research on SRL from our team and that of other researchers. We present MetaTutor followed by a synthesis of key research findings on the effectiveness of various versions of the system on learning outcomes. First, we focus on findings from self-reports, learning outcomes, and multimodal data and their contributions to our understanding of SRL with an ITS. Second, we elaborate on the role of embedded pedagogical agents as external regulators designed to scaffold learners’ cognitive and metacognitive SRL strategy use. Third, we highlight and elaborate on the contributions of multimodal data in measuring and understanding the role of cognitive, affective, metacognitive, and motivational processes. Additionally, we unpack some of the challenges these data pose for designing real-time instructional interventions that scaffold SRL. Fourth, we present existing theoretical, methodological, and analytical challenges and briefly discuss lessons learned and open challenges. (shrink)

This chapter focuses on one of the common fallacies in Western philosophy, 'legalistic mistake'. The use of “legal‐like” terms abounds outside the legal domain. But sometimes the users of these terms commit the fallacy Joel Feinberg called the legalistic mistake. On widening the use of such legal‐like terms, we must be cautious, for we might find ourselves guilty of making inferential mistakes or even proffering pure nonsense. The error, according to Feinberg, is committed by “one who, in stating a moral (...) question using a legal‐like term, uncritically imports the precision of that term in its strict legal sense, while excluding appeal to the kinds of criteria which alone can decide its use”. In “On Being 'Morally Speaking a Murderer’” Feinberg introduced the idea that, sometimes, using legal notions outside legal contexts may lead to a peculiar kind of fallacy he called the legalistic mistake. Esse trabalho discute a renovação e a centralidade do conceito de estrutura no projeto ontológico de Merleau-Ponty. Estabelece, primeiro, a ideia de que na obra de Merleau-Ponty não existe um sentido unívoco para a noção de estrutura, mas uma polissemia de usos e sentidos que acompanham o desenvolvimento do seu pensamento. Merleau-Ponty, sobretudo no momento da elaboração d’O visivel e o invisivel, não objetivava apenas se apropriar da noção de estrutura – gestalt – já em uso na psicologia, na linguística (...) e na etnologia, mas aprofundá-la na sua matriz filosófica, explorá-la como um novo regime de pensamento. Portanto, nossa hipótese de trabalho é que, em O visivel e o invisivel, a estrutura deixou de ser considerada apenas como a significação original da percepção e passou a ser pensada como condição do “ser-no-mundo”, um elemento essencial para uma nova noção de cogito – ser bruto –, sem os prejuízos da noção de cogito tácito que Merleau-Ponty reconheceu na Fenomenologia da percepção. This text represents our first attempting to offer a Metaphysic model to interpret the late modernity (which emerges in the middle of the 18th century and goes along until the end of the IIWW) through the concept of Teleontology. Thus, Teleontology means the procedure of the spirit of the late modern age to shift its paradigms from ontology (an investigation about the being as being, in which existence means an attribute) to teleology, in which essence must be conquered and revealed (...) in the final of a progressive process. Instead of Being, Man became the main object of this investigation; the question of the being as being has given way as to an enlightened concept of being-man (never reached) as also to the task to achieve this in order to satisfy what reason designed to human species. However, as this project of achieving the concept of Being-Man advanced, its true nature became clear: a unilateral and arbitrary colonial expansion, which forced everyone to follow Teleontological paradigms. Teleontology can demonstrate that Greek-Christian metaphysics means a particular element (never universal) submitted to a specific culture and, in this case, expresses the structure of Eurocentric thought that became global by way of the expanding of capitalism/colonialism. Specifically, in this text, we propose to investigate: 1 - what is Teleontology; 2 - what are its objects; 3 - what are its origins. (shrink)

Does the desirability of social institutions for public goods provision depend on the extent to which they include mechanisms for endogenous enforcement of cooperative behavior? We consider alternative institutions that vary the use of direct punishments to promote social cooperation. In one institution, subjects participate in a public goods experiment in which an initial stage of voluntary contribution is followed by a second stage of voluntary, costly sanctioning. Another institution consists of the voluntary contribution stage only, with no subsequent opportunity (...) to sanction. In a third stage subjects vote for which institution they prefer for future interactions: do they prefer one that does allow sanctions or one that does not allow sanctions? Our results show that even though sanctions are frequently used when available, the clear majority of individuals vote for the institution that does not allow sanctions. Thus, a distinction is required between the principles that guide the choice of institutions and the principles that apply to actions guided by institutions. Our results indicate that it is the wealth generated by the institution that determines its desirability. (shrink)

Explains the nature of ethical and religious humanism, differentiates secular and religious humanism, and stresses the importance of preserving the freedom, dignity, and well being of all people.

The purpose of the present study is to examine the attitudes of Portuguese chartered accountants with respect to questions of ethical nature that can arise in their professional activity. Respondents were asked to respond to the Ethics Position Questionnaire developed by Forsyth (Journal of Personality and Social Psychology 39(1), 175–184, 1980), in order to determine their idealism and relativism levels. Subsequently, they answered questions about five scenarios related to accounting practices, with the objective of measuring their ethical judgments. Based on (...) the idealism and relativism levels of our respondents, they were classified into one of four groups, representing different ethical ideologies (absolutism, exceptionism, subjectivism, and situationism). The results indicated that age was the major determinant of relativism. Contrary to previous research, older respondents revealed themselves significantly more relativistic than younger ones. Gender seems to be the most important determinant of ethical judgments; against expectations, men evidenced significantly stricter judgments than women in two of the five scenarios. Findings also indicated that respondents’ ethical judgments did not differ significantly based on their ethical ideology, supporting the idea that ethical ideology is not an important determinant of ethical judgments. Using the insights of evolutionary epistemology, the author develops a new naturalist realist methodology of science, and applies it to the conceptual, practical, and ethical problems of the social sciences.

Since before we can remember, humanity aims to overcome its biological limitations; such a goal has certainly played a key role in the advent of technique. However, despite the benefits that technique may bring, the people who make use of it will inevitably be under risk of harm. Even though human technical wisdom consists in attaining the best result without compromising anybody’s safety, misuses are always a possibility in the horizon. Nowadays, technology can be used for more than just improving (...) human capacities, preserving and restoring health or promoting human well-being. It also enables us to overcome human limitations and reach way beyond our "natural design". That being said, what could possibly justify the fear for these new directions of biotechnology? Should medicine and health care change their traditional goals and begin searching for artificial improvements to wellness in human nature? In this paper, I will hereby present and briefly discuss the main topics of the contemporary issue of human enhancement: the therapy-enhancement distinction, the possibility of cognitive enhancements and better physical performances, the fight against senescence, the arguments for and against human eugenics, the search for perfection, the quest of moral enhancement, the problem of public priorities, and some questions on medical ethics. Then, finally, I will want to present some realist perspectives on the subject. (shrink)

Troubled conscience may jeopardize the health of healthcare personnel and, hence, the quality of care provided. Learning more about how personnel deal with their troubled conscience therefore seems important. The aim of this study was to describe personnel’s experiences of how they deal with troubled conscience generated in their daily work in municipal care of older people. Interviews were conducted with 20 care providers and analysed with a thematic content analysis. The findings show that in order to deal with troubled (...) conscience, personnel dialogued with themselves and with others. They took measures in a direction they perceived to be correct, and they expressed a need for distancing and re-energizing. It is of importance to share situations that generate troubled conscience in order to find ways to deal with them. Reconsidering one’s ways of dealing with troubled conscience may give care providers an opportunity to reach consensus within themselves. (shrink)

In Unfit for the Future, Ingmar Persson and Julian Savulescu present a sophisticated argument in defense of the imperative of moral enhancement. They claim that without moral enhancement, the future of humanity is seriously compromised. The possibility of ultimate harm, caused by a dreadful terrorist attack or by a final unpreventable escalation of the present environmental crisis aggravated by the availability of cognitive enhancement, makes moral enhancement a top priority. It may be considered optimistic to think that our present moral (...) capabilities can be successfully improved by means of moral education, moral persuasion, and fear of punishment. So, without moral enhancement, drastic restrictions on human freedom would become the only alternative to prevent those dramatic potential outcomes. In this article, I will try to show that we still have reason to be less pessimistic and that Persson & Savulescu’s arguments are fortunately unconvincing. (shrink)

Background: Conscience is an important concept in ethics, having various meanings in different cultures. Because a growing number of healthcare professionals are of immigrant background, particularly within the care of older people, demanding multiple ethical positions, it is important to explore the meaning of conscience among care providers within different cultural contexts. Research objective: The study aimed to illuminate the meaning of conscience by enrolled nurses with an Iranian background working in residential care for Persian-speaking people with dementia. Research design: (...) A phenomenological hermeneutical method guided the study. Participants and research context: A total of 10 enrolled nurses with Iranian background, aged 33–46 years, participated in the study. All worked full time in residential care settings for Persian-speaking people with dementia in a large city, in Sweden. Ethical considerations: The study was approved by the Regional Ethical Review Board for ethical vetting of research involving humans. Participants were given verbal and written study information and assured that their participation was voluntary and confidential. Findings: Three themes were constructed including perception of conscience, clear conscience grounded in relations and striving to keep a clear conscience. The conscience was perceived as an inner guide grounded in feelings, which is dynamic and subject to changes throughout life. Having a clear conscience meant being able to form a bond with others, to respect them and to get their confirmation that one does well. To have a clear conscience demanded listening to the voice of the conscience. The enrolled nurses strived to keep their conscience clear by being generous in helping others, accomplishing daily tasks well and behaving nicely in the hope of being treated the same way one day. Conclusion: Cultural frameworks and the context of practice needed to be considered in interpreting the meaning of conscience and clear conscience. (shrink)

A vivência das crianças ciganas no mundo apresenta várias lacunas que vêm sendo estudadas por pesquisadores da área da sociologia, antropologia, psicologia e educação, com a intenção de compreender a forma como as escolas enfrentam o desafio de ensinar, com êxito, crianças de etnias diferentes. Discutir acerca da vida da criança cigana e o brincar no seu processo de escolarização frente aos olhos dos professores se constitui no nosso principal objetivo. A ênfase maior deste estudo está centrada na percepção dos (...) professores sobre a inserção das crianças ciganas no processo de escolarização na rede regular de ensino, assim como conhecer de que forma o lúdico está inserido no ambiente educacional e se vem contribuindo para diminuir o insucesso escolar de alunos/as de etnia cigana. As discussões feitas neste artigo contribuirão para o debate em busca de uma educação intercultural que valorize práticas lúdicas e partilhem a ideia de construir um futuro juntos e, consequentemente, com a construção de uma sociedade inclusiva e atuante. Quais sáo as teorias vulgares da moralidade criticadas por Hume na famosa passagem is-ought ? Quais eram seus defensores? Neste ensaio, trato de algumas diferenças entre Hume e Hutcheson que podem iluminar algumas respostas. Hume, ao contrário de Hutcheson, combateu toda forma de separaçáo da natureza humana em componentes naturais e divinos. O conceito de simpatia cumpre uma funçáo essencial nesse aspecto. Há bons indícios de que o jovem Hume adotou no Tratado uma estratégia abertamente crítica a todas as teorias (...) morais defendidas pelos pensadores, religiosos e moralistas de sua época. Isso inclui o voluntarismo contratualista, as éticas racionalistas, bem como as concepções religiosas influenciadas pelo dogmatismo evangélico escocês. Nisso Hume distanciou-se de Hutcheson, pois sua crítica também incluía as visões influenciadas pelas teorias do direito natural com referência na providência divina. A passagem is-ought sinaliza essa intençáo. Todavia, todo esse ímpeto juvenil resultou numa série de maus resultados pessoais, o que o levou, na maturidade a mitigar sua agressividade filosófica e a adotar, em seus escritos, uma atitude mais equilibrada. Este artigo propõe-se a discutir a possibilidade de utilizar as tecnologias digitais online e as redes sociais como espaço de aprendizagem digital de uma maneira que favoreça a aprendizagem cooperativa entre os estudantes, alicerçado na Epistemologia Genética de Jean Piaget. Este estudo foi baseado em uma pesquisa-ação, nas aulas de Matemática, realizada com estudantes do ensino médio integrado em informática do IFRS – Campus Osório (RS), em 2011 e 2012-1. Os estudantes demonstraram apropriação deste espaço de aprendizagem digital, como o (...) Facebook, e apontaram que este potencializa a aprendizagem cooperativa no que tange à disciplina de Matemática, por ações colaborativas com a professora. (shrink)

Esse artigo, instigado sobretudo pelas interpretações de Merleau-Ponty sobre Sócrates e Montaigne e pelo artigo Biografia e autobiografia: tangências e secâncias de Antonio Valverde, discute a relação entre vida e obra, considerando duas perspectivas: a importância da obra para a permanência – memória – de uma existência individual; o alcance e a validade filosófica da estratégia metodológica de recorrer ao exame de biografias e autobiografias para interpretar uma determinada obra.

Nesse trabalho discuto duas perspectivas sobre política e engajamento. Para descrever a primeiraforma de engajamento, muito comum nas redes sociais, faço uso do termo heideggerianofalatório. Esse tipo de engajamento se caracteriza pela reprodução do mesmo e pela negação dadiferença. Já a segunda noção de engajamento, pensada a partir das obras de Sartre e Merleau-Ponty, em clara oposição ao falatório, remete a um exame de três características fundamentais doengajamento intelectual: práxis, compromisso, responsabilidade.

A experiência democrática moderna indica que o nosso sistema político mantém uma relação de sobredeterminação com a liberdade. Toda forma de sistema político determina o alcance e o sentido da nossa liberdade, ao mesmo tempo em que a experiência concreta de liberdade modifica o sistema político. Sustentamos neste trabalho que a liberdade individual elevada ao princípio máximo de realização existencial e à consagração ideal de vida política é, ao mesmo tempo, o registro jurídico-político de que realmente vivemos em uma democracia, (...) sem, contudo, deixar de se apresentar como força desestruturante do próprio regime democrático. O presente trabalho tem como objetivo apresentar dois distintos projetos formativos: a paideia grega e a Bildung do esclarecimento alemão representada por Kant e Hegel, bem como o desenvolvimento desta última em Halbbildung no século XX. Para compreender os sentidos e contornos históricos em que essas formulações estavam postas, tornou-se necessário inseri-las no contexto mais geral das formações sociais em que elas estavam inseridas, revelando suas contradições.

In her paper entitled "Causal Laws and Effective Strategies" (1979), Cartwright sets out to establish the connection between laws of association and causal laws. In part Cartwright is trying to show the sense in which a cause increases the probability of its effect, and to explain what causal laws assert by giving an account of how causal laws are related to certain kinds of statistical laws. In section II we explicate the essential features of Cartwright's for- mulation and in section (...) III we argue that there are several reasons for believing that Cartwright's formulation is inadequate and must be rejected. Nonetheless, we believe Cartwright's formulation does contain two key insights into the nature of causation. In section IV we use these two insights to sketch out the key features of an alternative formulation that holds the certain laws of association are necessary conditions for causal laws. The alternative formu- lation, we believe, explains what it means to say a cause increases the probability of its effect. (shrink)

The analysis of multimodal argumentation in advertising is a crucial and problematic area of research. While its importance is growing in a time characterized by images and pictorial messages, the methods used for interpreting and reconstructing the structure of arguments expressed through verbal and visual means capture only isolated dimensions of this complex phenomenon. This paper intends to propose and illustrate a methodology for the reconstruction and analysis of “double-mode” arguments in advertisements, combining the instruments developed in social semiotics, pragmatics, (...) and argumentation theory. An advertisement is processed through a five-step path. The analysis of its context, text genre, and images leads to a first representation of the messages that it encodes both pictorially and verbally (step 1). These first semantic representations are further enriched by including their polyphonic articulations and presuppositions (step 2), their explicatures (step 3), and their dialogical functions and illocutionary forces (step 4). These pragmatic steps retrieve the commitment structure of the ad, which allows a further argument analysis conducted through argumentation schemes (step 5). (shrink)

Este artículo está basado en la Teoría de la Argumentación en la Lengua, originalmente creada por Oswald Ducrot y Jean-Claude Anscombre, y reformulada por Oswald Ducrot y Marion Carel. A partir de la TAL, Azevedo creó un modelo para la descripción semántica del discurso, con base en el cual se analiza un discurso publicado por la revista Nova Escola. En primer lugar, consideramos la argumentación, después, sigue una breve explicación del bloque semántico, de la cadena argumentativa y la polifonía, (...) seguido por la presentación del modelo de Azevedo y la análisis semántico-argumentativa de un discurso. Este análisis nos ha permitido demostrar, una vez más, la validez de la TAL y la eficacia del modelo de Azevedo para describir el significado del discurso seleccionado para este trabajo.Este artigo fundamenta-se na Teoria da Argumentação na Língua, criada inicialmente por Oswald Ducrot e Jean-Claude Anscombre, e corroborada/ reformulada por Oswald Ducrot e Marion Carel. A partir da TAL, Azevedo criou um modelo para a descrição semântica do discurso, com base no qual se analisa um discurso publicado pela revista Nova Escola.
